3. Contractor Referrals and Vetting

3.1 Our Vetting Process

Contractors in our network undergo a vetting process that may include verification of:

  • Business licenses and insurance coverage
  • Professional credentials and certifications
  • References and past work history
  • Background checks (where applicable)

IMPORTANT DISCLAIMER: While we take reasonable steps to vet contractors in our network, we do not guarantee the quality, timeliness, or results of any contractor's work. We are a referral service only and are not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any contractor.

3.2 Your Responsibility

When working with any contractor:

  • Conduct your own due diligence: Verify licenses, insurance, and references independently
  • Obtain written contracts: Always get detailed written agreements before work begins
  • Verify insurance: Confirm that contractors maintain current liability and workers' compensation insurance
  • Check local requirements: Ensure all necessary permits are obtained for your project
  • Get multiple quotes: Compare pricing and scope of work from multiple contractors when appropriate

3.3 No Guarantee of Results

America's Home Experts makes no warranties, express or implied, regarding:

  • The quality, timeliness, or cost of contractor services
  • The suitability of any contractor for your specific project
  • The availability of contractors in your area
  • The outcome or completion of any home improvement project

4. User Accounts and Registration

4.1 Account Creation

Certain features of our Services may require you to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized use of your account

5. User Conduct and Prohibited Activities

7. Fees and Payment

7.1 No Charge for Referrals

Homeowners are not charged a fee to receive contractor referrals through America's Home Experts. Any fees you pay are directly to the contractors you choose to work with.

7.2 Contractor Fees

If you are a contractor seeking to join our network, separate terms and fee schedules may apply. Contact us for information about contractor membership.

8. Third-Party Links and Services

Our Services may contain links to third-party websites, services, or resources that are not owned or controlled by America's Home Experts. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

9. Disclaimers and Limitations of Liability

9.1 "AS IS" and "AS AVAILABLE"

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

  • Your access to or use of (or inability to access or use) our Services
  • Any conduct or content of contractors or other users
  • Unauthorized access to or alteration of your data
  • The quality, timeliness, or outcome of contractor services
  • Any disputes between you and contractors

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO AMERICA'S HOME EXPERTS, IF ANY, IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

CONTRACTOR RELATIONSHIP DISCLAIMER: America's Home Experts is a referral service only. We are not a party to any agreement between you and contractors. Any contract you enter into with a contractor is directly between you and that contractor. We are not responsible for any disputes, damages, injuries, or losses arising from contractor services.

10. Indemnification

You agree to indemnify, defend, and hold harmless America's Home Experts, its officers, directors, employees, agents, affiliates, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use or misuse of our Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your interactions or disputes with contractors
  • Any content you submit to our Services

11. Dispute Resolution

11.1 Informal Resolution

If you have a dispute with us, please contact us first to attempt an informal resolution. We'll work in good faith to resolve the matter.

11.2 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Services shall be resolved by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA). The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND AMERICA'S HOME EXPERTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.

12. Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
